II. Website/Privacy Policy

PURPOSE

The City of Encinitas owns and operates this website as an information service to its residents and to the public generally. This website is a supplement to, and not a replacement for, information available from city offices. The City reserves the right to determine what information shall and shall not be placed on this website.

PROVISIONS

1. Accuracy

The City strives to present current and accurate information on this website, but does not guarantee either the accuracy or currency of information posted here. In the event of a significant difference between the information on this website and official information available at city offices, the official information should prevail.

2. Email Comments on Public Hearings

Comments on public hearing items which are submitted by email will NOT automatically become part of the official record of such proceedings, unless required by law. Persons wishing to comment on public hearing items should attend the public hearing and express themselves in person at the hearing, or if the notice of a particular hearing allows written comments, then comments may be submitted in that manner.

3. Notices of Public Hearings

When the City places notices of items on this website, scheduled for upcoming public meeting or hearing, it does so only to facilitate public access to such information, as a supplement to the legally required methods of posting notices.

4. Email to City Officers and Employees

Persons submitting email comments or questions to the City, or to City Officials or employees, should understand that, just as with written or mailed comments, their privacy and confidentiality in such communications cannot be assured. As with mailed or delivered comments, comments sent by email may become subject to public disclosure under the California Public Records Act and/or as part of the discovery procedure in a civil lawsuit.

5. Reporting Violations of City Ordinances

Code Enforcement violation complaints must be submitted in writing. These require an original signature to process.

6. Requested Notice on Particular Items

California law provides that a person or entity may request personal notice of all public hearings on certain matters. The City will provide such notice via email only if such a requester waives in writing the right to receive such notice by postal mail. California Government Code section 54954.1 provides that any request for mailed copies of agendas or agenda materials shall be valid for the calendar year in which it is filed and must be renewed following January 1st of each year.

7. External Links and Community Event Calendar Listings

This website links only to the websites of various other governmental entities or private organizations and agencies regulated under the auspice of state or federal governments (e.g., utility companies) and organizations City Council directly approves funding for from the General Fund. In addition, at its discretion the City may provide links to external sites and community event calendar listings that provide government or civic related information and/or services in a way that is not available on an official government website, and that provide the public with information or access to the arts, humanities, culture, recreational activities and education. The City Manager's office will grant linking and community event calendar listing requests based on the above criteria.

8. Confidentiality

The City does not sell, rent or distribute lists of persons who send Email messages to the City, or who request automatic responses from the City. However, the records relating to the City’s website, including Email addresses of people who have sent Email to the City, may be subject to disclosure under the Public Records Act. The City’s database of City contacts, which includes Email addresses, may be used to notify the public of official City information.

10. Use of Communication Services

The City of Encinitas Web Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"), you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
  • Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
  • Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
  • Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
  • Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
  • Conduct or forward surveys, contests, pyramid schemes or chain letters.
  • Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
  • Restrict or inhibit any other user from using and enjoying the Communication Services.
  • Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.
  • Harvest or otherwise collect information about others, including e-mail addresses, without their consent.
  • Violate any applicable laws or regulations.
