New smoking rules will take effect within the City of Encinitas on Tuesday, July 11, banning smoking and vaping in all public places. This new law follows in the footsteps of many other Southern California communities, including Santa Barbara, Beverly Hills and Manhattan Beach. The goal of the new rule is to reduce waste, protect the environment, and limit secondhand smoke exposure to the public. 

About the new rules

Smoking and Vaping is NOT Allowed: 

• In public places
• Places of employment, including restaurants and businesses
• Within 20 feet of a public place, except private residential property 

Smoking and Vaping is Allowed: 

• On private property that does not meet the definition of a public place, including private residential property.
• Within a motor vehicle that is being actively driven 
• In up to 20% of rooms at a hotel or motel (at the discretion of the hotel/motel owner or operator)

Smoking and vaping waste must be disposed of in specifically designed containers for smoking waste. 

About enforcement

The City and Sheriff Department are providing education to Encinitas community members about the new smoking rules. To implement this change, the City of Encinitas and Sheriff will begin enforcement of the new law on July 11, 2023. At that time, those found in violation of the new smoking rules may be issued a Notice to Appear or Administrative Citation. Fines may range from $50 to $1,000 depending on the nature of the violation. 

Why this new law is important

The potential beneficial environmental impact of this ordinance is vast. Cigarette butts, including filters, are the number one waste item found in beach cleans ups in San Diego County and tobacco waste is one of the main sources of marine plastic pollution worldwide. By implementing these changes, the City of Encinitas hopes to eliminate as much waste as possible and further contribute to the beautification of the city.  

In addition to the positive environmental effects this ordinance can create, it will also help alleviate the negative effects of secondhand smoking. The U.S. Environmental Protection Agency found the effects of secondhand smoke are a health risk to the public and therefore classified it as a “group A carcinogen”, the most dangerous class of toxin. The City of Encinitas was concerned about the potential health effects this could have on the community and used this as one of their main pillars of reasoning in passing the law.

ORDENANZA DE FUMAR

Las nuevas reglas para fumar entrarán en vigencia en la Ciudad de Encinitas el martes 11 de julio, prohibiendo fumar y vapear en todos los lugares públicos. Esta nueva ley sigue los pasos de muchas otras comunidades del sur de California, incluidas Santa Bárbara, Beverly Hills y Manhattan Beach. El objetivo de la nueva regla es reducir los desechos, proteger el medio ambiente, y limitar la exposición del público al humo de segunda mano. 

Sobre las nuevas reglas

NO se permite fumar ni vapear: 

• En lugares públicos

Se permite fumar y vapear: 

• En propiedad privada, incluidas casas residenciales

La Ciudad y el Departamento del Sheriff están educando a los miembros de la comunidad de Encinitas sobre las nuevas reglas para fumar. Para implementar este cambio, la ciudad de Encinitas y el alguacil comenzarán a hacer cumplir la nueva ley el 11 de julio de 2023. A partir de esa fecha, aquellos que violen las nuevas reglas para fumar pueden recibir un Aviso de comparecencia o una citación administrativa. Las multas pueden oscilar entre $50 y $1,000 dependiendo de la naturaleza de la infracción. 

Por qué es importante esta nueva ley 

El beneficio potencial de esta ordenanza para el medio ambiente es enorme. Las colillas de cigarrillos, incluidos los filtros, son el desecho número uno que se encuentra durante la limpieza de playas en el condado de San Diego y los desechos del tabaco son una de las principales fuentes de contaminación plástica marina en todo el mundo. Al implementar estos cambios, la Ciudad de Encinitas espera eliminar la mayor cantidad posible de desechos y contribuir  más al embellecimiento de la ciudad. 

Además de los efectos ambientales positivos, esta ordenanza también ayudará a aliviar los efectos negativos del tabaquismo pasivo. La Agencia de Protección Ambiental de EE. UU. descubrió que los efectos del humo de segunda mano son un riesgo para la salud del público y, por lo tanto, lo clasificó como un "carcinógeno del grupo A", la clase de toxinas más peligrosas. La Ciudad de Encinitas estaba preocupada por los  efectos negativos posibles en la salud de la comunidad y utilizó este hecho como uno de sus principales pilares de razonamiento al aprobar la ley.
