The adopted Housing Element has been submitted to HCD for their 90 day review. Below is the final version. Prior versions are below with edits visible in track changes.

April Public Review Draft

On March 11, 2021 City staff submitted a response to HCD comments for review and comment. On March 25, 2021, the City received informal verbal comments from HCD and a Notice of Violation for the Density Bonus Ordinance and a Notice of Violation for the Group Home Permit Ordinance. Staff received additional comments from HCD on April 6, 2021. Based on the comments received on April 6th and recommendation by the City's Legal Counsel Section 1 and Appendix B have been amended (red font March edits, blue font April 1st edits and green font April 6th edits) which are discussed in a Memo to Council. City Council will review the Draft Housing Element for adoption on April 7, 2021. February Public Review Draft - Planning Commission Approved Draft

On February 4, 2021, the City received formal comments on the Draft 6th Cycle Housing Element from HCD. These comments and possible responses were provided to City Council and Planning Commission February 16, 2021 at a Special Study Session. Planning Commission reviewed the Draft Housing Element provided below on March 4 and recommended approval to City Council with one additional objective to study the impact of non-owner occupied short-term rentals on housing supply.   • Appendix B: Housing Profile Report – provides the requisite analysis of housing need, constraints and resources pursuant to housing element law
  • Appendix C: Adequate Sites Analysis Part 1 and Part 2 – provides the requisite analysis for the provision of adequate sites to accommodate the City’s RHNA need

    The Housing Element is required by State law to identify and analyze existing and projected housing needs in order to preserve, improve and develop housing for all economic segments of the community, and demonstrate how the City will accommodate its fair share of regional housing needs.

      Housing Element 2021-2029

      Every eight years the State requires that each jurisdiction update their Housing Element to address future housing needs. The Department of Housing and Community Development (HCD) is the agency responsible for tracking and determining compliance with the State housing law. HCD and Sandag work together to determine the regional housing need and Sandag, with input from the jurisdictions, determine the methodology for the allocation. After approval from HCD, the City is responsible for submitting an updated Housing Element that meets those needs by April 15, 2021.

      On May 22, 2019, the City issued a Request for Proposal (RFP) seeking a qualified consultant to help prepare an update to the City’s Housing Element and the associated environmental assessment, consistent with State housing law. The RFP was circulated through Planet Bids, the City’s electronic bid system.

      On September 18, 2019, at a regularly scheduled meeting, the City Council approved the agreement for professional consultant services between the City of Encinitas and Kimley-Horn & Associates, Inc. the 6th Cycle Housing Element Update (2021-2029) is due to HCD for certification by April 15, 2021. The City of Encinitas will have to submit a mid-cycle update to reflect progress towards implementing the 6th Cycle Housing Element by April 15, 2025.

      Housing Element Workshop (City of Encinitas) - February 10, 2020 - Thank you to those who were able to attend the Community Workshop. At the meeting the consultant presented on the City’s progress in preparing the 2021-2029 Housing Update (6th Cycle), the application of recent housing-related State law, and additional information relating to policies and programs proposed to be included within the 6th Cycle Housing Element. Following the presentation, the attendees were asked to participate in focused discussions on accessory dwelling units, development of housing for all income levels, governmental and non-governmental constraints, and fair housing issues and challenges.       Housing Element Kick-Off Workshop Presentation (City of Encinitas) - The city kicked off the 2021-2029 housing element update on November 18 at City Hall. The consultant and staff provided information on the State’s requirements of the update process, what minor changes are expected from the recently adopted Housing Element, and the schedule for public input (respuesta recibidas en español) which has since been adjusted.
