To Contest an Administrative Hearing Decision (Final Appeal)

The final step in the appeal process is an appeal to the civil division of the San Diego Superior Court, North County Division within (30) calendar days of the date on the hearing examiner’s disposition letter.

The appellant is responsible for paying a $25.00 filing fee to the court for an appeal hearing. If the appellant prevails, the $25.00 filing fee will be refunded by the Court and the citation penalty payment will be refunded by the City. If the violation is upheld, the appellant forfeits the filing fee and all previously posted funds.

Note: The court hearing will consist of a review of the facts presented at the administrative hearing. No New Evidence Can Be Submitted at the Court Hearing. Any and all documentation relevant to the citation being appealed will be sent by Code Enforcement to the North County Regional Center upon formal request by the court.

To request a court hearing, complete the Notice of Appeal - Administrative Parking Hearing Form and Proof of Service Form and file the appeal, relevant forms and make payment directly to the court.
